Datran Media LLC and our wholly-owned subsidiaries (collectively "Datran Media" or "we") respect and value your privacy. As such, we have created this privacy policy for Aperture, which is a service we provide for other businesses. Aperture enables (i) the measurement of the attributes of the audience that views a website, email or marketing campaigns and (ii) delivers relevant advertising to consumers based on those attributes (the "Aperture audience business"). This Privacy Policy details Datran Media's treatment of personally identifiable information ("PII") and other information that we collect and use in the Aperture audience business.
Datran Media reserves the right to modify this Privacy Policy from time to time. Changes to the Privacy Policy will be posted on this website and the effective date of the Privacy Policy will be modified to reflect the effective date of the most recent version. If a material change to our information practices occurs in the future, we will only use information collected from the time of the policy change forward for these new purposes unless we have your consent.
Types of Information We Collect or Maintain About Consumers in our Aperture Audience Business
- Personally Identifiable Information
For our Aperture audience business, we place cookies ("Aperture audience cookies") on consumers' browsers at partners' registration pages or when consumers access certain partners' emails. These partners may make PII available to Aperture, however the Aperture audience cookies, like any other cookies placed by Datran Media, do not contain any PII. The PII our partners may share include the following:
- First and Last Name
- Physical Address
- Email Address
- Phone Number
- Fax Number
- Any other PII the user submits during the course of normal correspondence with Datran Media or its third-party partners
Though partners may share such data it is deidentified prior to use in any cookies. Further, we have implemented technological and procedural limitations to prevent PII from being associated, merged or linked with our cookies, behavioral or web data and to prevent our cookies from being re-identified through statistical methods. - Non-Personally Identifiable Information
Our Aperture audience business receives non-personally identifiable information from third party data providers and other Datran Media businesses including demographic information (such as age, gender, income range and geographic region) and behavioral data (such as sites visited and clicks within those sites). This data (the "audience data") may be associated with an Aperture audience cookie only in de-identified form. When the Aperture service is used to measure a website or ad campaign, we may collect additional non-personally identifiable data including IP Address, and Consumer click-stream data ("web data").
How We Use and Share Consumer Information in the Aperture Audience Business
- Consumer Information Accessed by Datran Media for Purposes of Aperture Audience Business
Our Aperture audience business uses PII for the purpose of enhancing the Aperture audience cookies with non-PII data, however, PII is not associated, merged or linked with any cookie, behavioral or web data. We have implemented technological and procedural limitations to prevent PII from being associated, merged or linked with our cookies, behavioral or web data and to prevent our cookies from being re-identified through statistical methods.
- Sharing of Consumer Information with Third Parties
The Aperture audience business may share PII with service providers and partners who assist us with the Aperture audience business, but those service providers will not use this PII for their own business purposes and are prohibited by contract from sharing this PII with any party other than Datran Media. Businesses that we share PII with may include, but are not limited to: including lookup and reference, data enhancement, suppression and validation services. In addition, we may share non-PII data with other advertising networks. These are entities that connect advertisers to websites hosting advertising, so that these third parties can match ads to appropriate audiences. All of these services enable us to deliver marketing communications to you, verify and update information about you and offer you better tailored and more relevant advertising.
Datran Media may also share PII in the following limited circumstances: (1) upon receipt of a properly authorized and authenticated governmental request for information; (2) in response to a subpoena or a court order; (3) to comply with relevant laws; (4) in response to an investigation of fraud regarding a specific consumer; (5) in an effort to safeguard the person or property of a Datran Media employee or a third party; or (6) when Datran Media believes it is necessary to protect our interests or we believe in good faith that the law requires the sharing of your personal information.
Finally, Datran Media may, in the future, decide to sell, merge or otherwise reorganize its business. Datran Media reserves the right to transfer and disclose PII in this circumstance, but data collected by Datran Media will be governed by the same privacy policy that existed prior to any change in business conditions unless you consent to the new privacy policy.
How we use Cookies in the Aperture Audience Business
We deploy Aperture audience cookies when consumers open or "click" a link within the emails we or our partners send or when consumers register or login on a partner website. A cookie is a piece of data stored on your hard drive. The Aperture audience cookie is a random, unique code linked to a de-identified profile that includes audience data as described above. Our cookies do not contain and are not linked to PII. We use the Aperture audience cookie to track and monitor users our of partner's websites, emails and ad campaigns, and for delivering relevant advertising.
Cookie-based data is only retained for thirteen months.
Audience Cookie Choice
Should you wish to opt-out of us placing an Aperture audience cookie on your browser, you can click here to deploy an "opt-out" cookie on your browser. This cookie, when installed on your browser, will prevent us from placing a new Aperture audience cookie on that browser and from collecting data on that browser.
The NAI's opt-out tool allows you to opt-out of the data collection and targeted ad programs of other NAI members. You may access the NAI opt-out tool here. PrivacyChoice's opt-out tool allows you to opt-out of other third parties (in addition to NAI members) who may place cookies on your computer. Our opt-out tool, and the NAI opt-out tool, are cookie-based. Both opt-out tools only prevent us from collecting data pertaining to you on the browser on which they are installed, and will only function if your browser is set to accept third-party cookies. If you delete an opt-out cookie from a browser's cookie files, we may collect data and place a new cookie unless an opt-out cookie is reset on that browser. PrivacyChoice offers both a bookmark and browser plugin that can make your opt-out choices more durable.
Additionally, you may prevent us from collecting data on a browser by blocking third-party cookies in that browser. If you block third-party cookies from being set on your browser, you may not be able to enjoy some features or functionality of, and you may see the same content and advertisements repeatedly on some websites.
Security
We endeavor to safeguard and protect our users' information. When our third-party marketing partners transfer PII to us, such information is protected both online and offline. The servers in which we store PII and non-PII consumer data are kept in a secure physical environment. Datran Media has security measures in place to protect against the loss, misuse and alteration of such information under our control. Therefore, Datran Media cannot warrant that your information will be absolutely secure.
Children's Privacy
Datran Media places the highest value on the privacy of children. Datran Media does not knowingly collect PII from children under the age of 13.
Access
Consumers wishing to review PII collected by Datran Media on this site should write to Datran Media Privacy Department, 345 Hudson Street, 5th Floor, New York, New York, 10014. Datran Media may take reasonable steps to confirm the identity of the consumer in an effort to prevent identity theft.
Consumers wishing to review PII list managed by Datran Media but collected on a third-party site pursuant to the third-party's privacy policy should contact the third-party company responsible for the collection of the consumer's PII.
Your California Privacy Rights
California Civil Code Section 1798.83 permits California residents who have provided PII to Datran Media or its partners to request certain information regarding Datran Media's disclosure of PII to third parties for their direct marketing purposes. Within thirty days of receiving such a request, we will provide a list of the categories of PII disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the address specified in this section.

For PII collected from consumers inside the European Union, Datran Media will not manage that consumer data unless that consumer first requested, pursuant to clear and conspicuous notice, to receive such types of marketing communications. Moreover, the EU recipient must be given clear and conspicuous notice that the data is going to be shared with third parties for marketing purposes, and that notice must be given prior to receipt of the recipient's permission.
